Android Apps Additional Terms

These Android Apps Additional Terms (the “Additional Terms”) form part of the written or electronic agreement for Trimble’s provision of products, software, and/or services into which agreement this Addendum is expressly incorporated by reference (the “Agreement”) by and between Trimble Inc. or one of its corporate affiliates as specified in the Agreement (“Trimble”), and the other party to the Agreement (“you” or “your”) (each, a “Party,” and together, the “Parties”), and applies to your license of an Android application from Trimble (an “Android App”). This Addendum is of no force or effect unless expressly incorporated by reference into an Agreement. In the event of a conflict between these Additional Terms and a corresponding term or provision of the Agreement, these Additional Terms control with respect to Android Apps only.
1. Acknowledgment
The Agreement is concluded between you and Trimble only, not Google Inc. (“Google”) or any of its subsidiaries, and Trimble is solely responsible for the Android App and its content. Google will not be responsible for, and will not have any liability whatsoever under, the Agreement.
2. Attribution
Android is a trademark of Google Inc. Use of this trademark is subject to Google Permissions.
3. Apache Open Source
To the extent an Android App contains code licensed under the Apache open-source license, this Section 3 applies. The Android App is licensed under the Apache License, Version 2.0 (the “License”); you may not use the Android App except in compliance with the License. You may obtain a copy of the License at https://www.apache.org/licenses/LICENSE-2.0. Unless required by applicable law or agreed to in writing, the Android App distributed under the License is distributed on an “AS IS” BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, either express or implied. See the License for the specific language governing permissions and limitations under the License.
4. Legal Compliance
You represent and warrant that (i) that you are not located in a country subject to a U.S Government embargo or that has been designated by the U.S Government as a “terrorist supporting” region, and (ii) you are not listed on any U.S Government list of prohibited or restricted parties.
5. Changes to Terms
Trimble may modify these Additional Terms by posting a new version on this page if Trimble determines such modifications necessary for continued compliance with its agreement(s) with Google and/or any of its affiliates. If you object to any such modifications, you will promptly (but in any event within thirty (30) calendar days of the date of posting) notify Trimble of such objection, and the Parties shall work together in good faith to discuss and resolve such concerns.
